Welcome to 2Hearts4Love.com, operated by Ignite Product Design, a Las Vegas, Nevada USA Company (“us,” “we,” the “Company”, “2H4L”, or “2Hearts4Love”).

1. ACCEPTANCE OF TERMS OF USE PLEASE READ THE TERMS OF THE AGREEMENT CAREFULLY. IF YOU CHOOSE TO ACCEPT THE AGREEMENT BY CHECKING THE "I AGREE" BOX, YOU UNDERSTAND AND CONSENT that by accessing or using our Services on 2Hearts4Love.com (the "Website"), the 2H4L mobile application (the "App"), or any other platforms or services 2H4L may offer, to be bound by the terms set forth in this End User Service Agreement, our Privacy Policy, Cookie Policy, Arbitration Procedures, Safety Tips, Community Guidelines, and all other provisions and policies associated with your access and use (the "Agreement").

This Agreement applies to anyone who accesses or uses our Services, regardless of registration or payment status.

If you do not wish to accept all terms and conditions contained in this Agreement, do not check the "I AGREE" box or complete the registration process for this Service.

We may make changes to this Agreement and to the Service from time to time. We may do this for a variety of reasons including reflecting changes in or requirements of the law, adding or removing features, or changes in business practices. The most recent version of this Agreement will be posted on 2Hearts4Love.com, and you should regularly check for the most recent version. The most recent version is the version that applies. If you continue to use the Service after the changes become effective, then you agree to the revised Agreement. You agree that this Agreement shall supersede any prior agreements (except as specifically stated herein), including but not limited to events, agreements, and conduct preceding your acceptance of this Agreement. If you do not accept a change to the terms, you should stop using our Services immediately.

2. INTRODUCTION

For purposes of this Agreement, after you register with the Service, you will be referred to as a "Member." You may register as a Member at no cost to access the principle features of the Service. Private Photos, Premium placement of Member profiles and premium profile formatting is available as an additional function to Members through a profile advertising program, as described below.

Third party websites may provide links to our website ("Third Party Sites"). These Third Party Sites are not owned or operated by 2Hearts4Love.com. We do not provide any data about our Members to these Third Party Sites, and we are not responsible for the privacy policies or information practices of these Third Party Websites; we also are not liable for any information that you share with these Third Party Websites prior to being directed to us.

3. OVERVIEW

After you have consented to this Agreement and registered to use the Service, you can communicate with other Members and communicate with us through the Service. To set up an Account you must be at least eighteen (18) years old, provide us with your first and last name, have a valid email address, and create a user name and password. You also must have a valid credit card/payment method if you choose to register for the optional premium (“Alpha Ad”) profile placement or to access certain Private Photos. By creating an Account you represent and warrant that all information you have provided is accurate and true.

You may register to use our Service at no cost, including but not limited to the ability to send unlimited likes and messages to other Members. You may elect to participate in Alpha Ad Silver and/or Gold profile premium placement or access certain Private Photos, as described in further detail on our website.

Upon participation in Alpha Ads or certain Private Photos, you will set your account preferences and whether you choose automatic or manual renewal.

Alpha Ad participation or access to certain Private Photos will allow for automatic or manual renewal choices. For automatic renewal, you will be charged the increment indicated on your settings on the monthly anniversary of your submittal for your account. For manual renewal, we will notify you of your options on or before the day the account is set to renew or expire. Notwithstanding the forgoing, upon your initial participation in our Alpha Ad program, you may cancel participation in Alpha Ads within three (3) business days of initially subscribing to the Alpha Ad service. You may receive a refund of any unused portion of your remaining account by notifying us through the contact information provided below. This three business day period is your "Trial Period". You may cancel your Alpha Ad at any time during the trial period by contacting us at mailsupport@mail.2hearts4love.com. Except for cancellations made during the Trial Period all fees paid for Alpha Ad placements are non-refundable.

There is no trial period for access to those Private Photos which may require a payment for you to access.

4. ACCOUNT ELIGIBILITY

You must be at least 18 years of age to create an account and use this Service. By creating an account you represent and warrant that:

1. You are at least 18 years old;
2. You are not located in a country that has been designated by the U.S. Government as a "terrorist supporting" country;
3. You are legally qualified to enter a binding contract;
4. You have never been convicted of or pled no contest to a felony, a sex crime, or any crime involving violence;
5. You are not required to register as a sex offender with any state, federal or local sex offender registry;
6. You are not a person who is barred from using the Service under the laws of the United States or any other applicable jurisdiction;
7. You will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations.

5. YOUR RESPONSIBILITIES AND CODE OF CONDUCT WE RESERVE THE RIGHT TO TERMINATE YOUR USE OF THE SERVICE (IN OUR SOLE DISCRETION) IF WE DETERMINE THAT YOU HAVE VIOLATED ANY PROVISION OF THE AGREEMENT, INCLUDING ANY ILLEGAL, SUSPICIOUS AND/OR UNAUTHORIZED USE OF OUR SERVICES, AND WE MAY TAKE ANY LEGAL RECOURSE THAT WE DEEM APPROPRIATE. WE MAY ALSO REFER ACTIVITIES THAT WE DEEM SUSPICIOUS OR ILLEGAL TO THE PROPER GOVERNMENTAL AUTHORITIES.

You are solely responsible for your interaction with other Members, whether online or offline. We are not responsible or liable for the conduct of any Members. If at any time you cease to meet these requirements, you must immediately delete your account.

By using our Services, you agree NOT TO:

1. submit any opinion of the Services without disclosing any association you may have with such content, as required by the Federal Trade Commission;
2. upload any content for the purpose of intentionally misleading anyone;
3. use the Service to solicit prostitution, or to promote the prostitution of another person;
4. publish any inappropriate or unlawful content;
5. publish content protected by intellectual property laws unless you own or control the rights thereto;
6. download Content posted by another user of our Service;
7. use our Service or any Content therein, for any business, marketing, advertising, or other commercial purposes;
8. post or send any photos containing vulgar or offensive materials;
9. use discriminatory language based on race, color, sex, sexual orientation, gender identity, religion, nationality, ethnicity, marital status, disability, or age;
10. spam, defraud, solicit money, or otherwise harass users of our Service;
11. violate any applicable laws or regulations with respect to your access and use of the Service;
12. misrepresent your identity, age, positions, or qualifications;
13. use our Services for any nefarious purpose;
14. harass, stalk, intimidate, assault, defame, or mistreat any person;
15. disseminate another person's personal information without his or her permission;
16. solicit money or items of value as a gift, loan, or form of compensation;
17. use another user's account;
18. disclose private information that you do not have the right to disclose;
19. imply that any statements you make are endorsed by 2H4L;
20. impersonate any another person without his or her permission;
21. post any Content that violates or infringes anyone’s rights of publicity, privacy, copyright, trademark or other intellectual property or contract rights;
22. post any Content that is hate speech, threatening or incites violence;
23. post any Content that promotes racism, bigotry, hatred or physical harm of any kind;
24. disseminate another person’s personal information without his or her permission;
25. post any content that was not written by you or was automatically generated;
26. post any content that Includes the image or likeness of another person without that person's consent (or in the case of a minor, the minor's parent or guardian);
27. hold 2H4L responsible for any content that is downloaded or copied and used by any third party person for any purpose;
28. post any content that violate any applicable laws including but not limited to the Communications Decency Act, 47 U.S.C. § 230(c);
29. engage in any activity that violates these Terms.

By using our Services, you AGREE TO:

1. comply with the latest version of these Terms of Use as posted on this website;
2. comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements;
3. treat other users in a courteous and respectful manner;
4. maintain a strong password and to protect the security of your login information.

Uploading or sharing of content or behavior in a way that 2H4L regards as inappropriate or unlawful, including actions or communications that occur on or off the Service that violate any of these terms may result in the immediate termination of your account without a refund of any purchase.

6. RIGHTS YOU ARE GRANTED BY 2H4L

For as long as you comply with these Terms, We grant you a limited, non-exclusive, non-transferable, revocable limited license to access and use our Service as expressly permitted herein. We reserve all rights not expressly granted herein. 2H4L grants you to access and use our Services for purposes as intended by us and permitted by these Terms and applicable laws.

This license is for the sole purpose of letting you use this Service, therefore you agree NOT TO:

1. use the Service for any commercial purposes without our written consent;
2. “frame” or “mirror” any part of the Service without written consent;
3. copy or reproduce in any way any images, trademarks, trade names, copyrighted material, or other intellectual property, without our written consent;
4. use the Service in any way that could negatively affect the servers or networks connected to the Service;
5. upload malicious code to compromise the security of the Service;
6. disguise the origin of any information transmitted through the Service;
7. probe or scan the vulnerability of our Service on any system or network;
8. use any manual or automatic device to access, retrieve, index, “data mine,” or in any way reproduce or circumvent the structure of 2H4L;
9. use meta tags or code containing any reference to the Service to direct any person to another website;
10. use or develop any third-party applications that interact with 2H4L without written consent;
11. access or publish the 2H4L application program without written consent.

7. RIGHTS YOU GRANT 2H4L

By creating an account, you grant us a worldwide, perpetual, non-exclusive, royalty-free, sub-licensable and transferable license to host, store, use, display, copy, reproduce, publish, modify and/or distribute information you authorize us to access from Facebook or other third-party source (if applicable), well as any information you post, upload, display or otherwise make available on the Service. The license you grant to 2H4L shall be non-exclusive, except this license shall be exclusive with respect to derivative works created through use of our Services.

You authorize 2H4L to act with respect to infringing uses of your Content taken from the Service by other members or third parties. Our license to your Content is for the purpose of operating, developing, providing, and improving this Service. This includes the authority but no obligation to send notices pursuant to 17 U.S.C. § 512(c)(3) (i.e., DMCA Takedown Notices) on your behalf. 2H4L is not obligated to take any action with regard to use of Your Content by other users or third parties. You agree that any Content you place on the Service may be viewed by other members and non-members and may be viewed by any person visiting or participating in the Service.

You have no reasonable expectation of privacy when using the Service. You understand that anything you post or communicate through the Service may be seen by other Members and Non-Members. You are solely responsible for all Content submitted to the Service. If you delete content from your profile, some content may remain available, including cached internet pages or other uses by third parties that are beyond our control. By checking the "I AGREE" box, you acknowledge that you agree that we do not assume any liability for or relating to third party use or cached content which is beyond our control.

You agree that all information that you submit upon creation of your account is accurate and truthful and you have the right to post the Content on the Service and grant the license to 2H4L. You agree that we may review Content you post as part of this Service. We may delete any Content that in our sole judgment violates this Agreement.

You agree that we, our affiliates, and third-party partners may place advertising on this Service. By submitting feedback to 2H4L regarding our Service, you agree that we may use and share such feedback for any purpose without compensating you. You agree that 2H4L may disclose your account information if required to do so by law or upon a good faith belief that such disclosure is necessary.

8. YOUR PROFILE CONTENT AND VISIBILITY

Do not share anything that you would not want others to see, that would violate this Agreement, or that may expose you or us to legal liability.

Your individual profile will be visible to other people around the world, so be sure that you are comfortable sharing Your Content before you post. Your profile will be visible to Members and Non-Member visitors to the site. However, only Members may interact with your profile through likes and messaging.

You will be able to post text and images to your profile within certain limitations (“Content”). Content you post, including your user name and images, may be featured on the publicly available (Non-Member) portions of 2hearts4Love. 2H4L, in our sole discretion, may reject submitted Content. You are solely responsible for submitted Content and shall indemnify, defend and hold us and our employees, officers, directors, shareholders and agents harmless for any and all losses, costs, disputes, demands, claims and liabilities (including reasonable attorneys’ fees) arising from your Content.

You may not display any personal contact or banking information (for example, names, home addresses or postcodes, telephone numbers, email addresses, URLs, credit/debit card or other banking details). If you choose to reveal any personal information about yourself, you do so at your own risk.

You agree that we may review your Content, and we have the right to remove, edit, block, or prevent access to any of your Content at any time in our sole discretion. Furthermore, you agree that we have no obligation to display or review your Content.

9. MEMBER CONTENT

Other Member Content belongs to another user who posted the content and is stored on our servers and displayed at the request of that user. You may not copy or use Member Content for any purpose except as explained in these Terms.

You may not use Member Content for commercial purposes, spam, harass, or make unlawful threats.

Content is the sole responsibility of the member who posts it, and 2H4L cannot guarantee that all

Content will comply with this Agreement.

10. OUR CONTENT

Any content and other intellectual property appearing on our Services is owned or licensed by us and protected by intellectual property law rights.

11. INAPPROPRIATE CONTENT AND MISCONDUCT

We do not tolerate any inappropriate conduct, whether on or off of the Services. We encourage you to report any inappropriate Member Content or misconduct by other Members. You may report another Member by clicking on the FLAG icon on the Member Profile and selecting from the multiple choice options. This action will remove this Member Profile from your future searches, creating a pop-up with a list of required multiple choice reasons for the conduct complaint, such as “Fake profile”, “Asking for money”, “Not pictures of this person”, “Not located where they say they are”, “Scammer”, “Abusive”, etc. You may also email 2H4L Customer Service at mailsupport@mail.2hearts4love.com. Member Content is subject to the terms and conditions of Sections 512(c) and/or 512(d) of the Digital Millennium Copyright Act 1998.

12. ACCOUNT SECURITY

You are solely responsible for maintaining the confidentiality of your user name and password. You must ensure all information used in connection with our Service is accurate and current, whether created by you or someone else. You must immediately notify us of any unauthorized use of your Account. We reserve the right, in our sole discretion, to terminate or suspend your Account, including if we have reason to believe that you have provided fraudulent information in connection with your Account.

13. OUR PROPRIETARY RIGHTS

Our Service and all logos, trademarks, buttons icons, images, pictures, graphics, content (“Our Content”) are protected under U.S. intellectual property laws, and are exclusively owned and/or controlled by us. Unauthorized use of Our Content is prohibited.

14. DISCLAIMER OF WARRANTIES

2H4L DISCLAIMS AND TAKES NO RESPONSIBILITY FOR ANY CONDUCT OF YOU OR ANY OTHER MEMBER, ON OR OFF THE SERVICE. 2H4L PROVIDES OUR SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW. WE MAKE NO REPRESENTATIONS ABOUT THE AVAILABILITY OF THE SERVICE OR THE CONTENT SUBMITTED. 2H4L GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR OTHERWISE WITH RESPECT TO OUR SERVICES (INCLUDING ALL CONTENT CONTAINED THEREIN), INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON- INFRINGEMENT.

2H4L DOES NOT REPRESENT OR WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE, ANY DEFECTS OR ERRORS IN OUR SERVICES WILL BE CORRECTED, OR THAT ANY CONTENT OR INFORMATION YOU OBTAIN ON OR THROUGH OUR SERVICES WILL BE ACCURATE. FURTHERMORE,

2H4L MAKES NO GUARANTEES AS TO THE NUMBER OF USERS AT ANY TIME; USERS' ABILITY OR DESIRE TO COMMUNICATE WITH YOU, OR CONDUCT BY USERS YOU MEET THROUGH THE SERVICES.

2H4L TAKES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANOTHER MEMBER POSTS, SENDS OR RECEIVES THROUGH THE SERVICE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK.

ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF OUR SERVICES IS ACCESSED AT YOUR OWN RISK. 2H4L IS NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR OTHER EQUIPMENT INCLUDING DAMAGE FROM ANY SECURITY BREACH OR FROM ANY VIRUS, BUGS, TAMPERING, FRAUD, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER LINE OR NETWORK FAILURE, OR ANY OTHER TECHNICAL OR OTHER MALFUNCTION. YOU ASSUME THE ENTIRE RISK OF LOSS OF CONTENT AND/OR DAMAGE DUE TO YOUR USE OF THE SERVICE.

15. LIMITATION OF LIABILITY

YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

WE AND OUR OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OR LOSSES (INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, WHICH YOU MAY INCUR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE, THE SERVICE.

16. INDEMNIFICATION

You agree to indemnify, defend and hold harmless 2H4L, our affiliates, and our respective officers, directors, agents, and employees from any and all loss, cost, disputes, demands, claims and liabilities (including reasonable attorneys’ fees) arising out of or incurred due to your breach of the Agreement, your use or misuse of the Service, your violation of any law or rights of any third party or your interaction with other users.

17. TERMINATION

You may terminate your participation at any time. If you have a dispute with us or with the Service, immediately cease all use of the Service. At that time we may delete Content you have submitted. If we terminate your Membership after the Trial Period has ended, you will not be entitled to any refund of unused fees. If you use a third party payment account, you will need to manage purchases through such account (e.g., Apple, Google Play) to avoid additional billing.

2H4L may terminate your account at any time without notice if we believe that you have violated this Agreement. Upon termination, you will not be entitled to any refund. If your account is terminated by you or by us for any reason, this Agreement shall continue and remain enforceable between you and 2H4L.

18. CHANGES TO SERVICES AND AGREEMENT

From time to time, we may modify, suspend, add, or discontinue any feature. We may at any time establish additional policies and practices concerning use of the Service. We reserve the right to change any term of this Agreement at any time, with or without prior notice. When we add new features that do not materially affect terms of the agreement, we may not update this Agreement.

19. PRIVACY POLICY

Please read our Privacy Policy available download on our website 2Hearts4Love.com. By using our Services, you agree that we may use your personal data in accordance with our Privacy Policy. We collect and use information about you and your use of the Service and Content for the purpose of developing and improving the Service. Please review our Privacy Policy for more information at: https://2hearts4love.com/privacy-policy.

20. MINORS

BY REGISTERING FOR AN ACCOUNT, YOU REPRESENT THAT YOU ARE AN ADULT OVER THE AGE OF 18, HAVE THE CAPACITY TO CONSENT, AND AGREE TO BE PERSONALLY BOUND BY ALL OF THE TERMS OF THIS AGREEMENT.

21. PURCHASES

When making a purchase on the Service, you may have the option to pay through your Apple ID or Google account (“External Service”) and you will be charged for the purchase in accordance with the terms disclosed to you at the time of purchase and the general terms applicable to your External Service Account. Some External Services may charge you sales tax.

If your External Service Purchase includes automatically renewing payments, your External Service Account will continue to be periodically charged for the payment until you cancel. The payment period will automatically continue for the price and time period you agreed to at the time of initial payment.

If you make a Purchase through our website, you agree to pay the prices you’ve selected as well as any sales or similar taxes that may be imposed on your payments, and you authorize 2H4L to charge the payment method you provide (your "Payment Method").

If you do not want your payment to renew automatically, you must log in to your External Service Account and follow instructions to manage or cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the App from your device.

If you initiate a chargeback or otherwise reverse a payment, 2H4L may terminate your account immediately in its sole discretion. In the event that your chargeback or other payment reversal is overturned, please contact 2H4L.

In addition, you authorize us to obtain updated or replacement expiration dates and card numbers for your credit or debit card as provided by your credit or debit card issuer. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer, or other provider.

22. REFUNDS

All purchases are final and nonrefundable, and there are no refunds or credits for partially used periods, except if the laws applicable in your jurisdiction provide for refunds.

For qualifying refunds, please contact 2H4L Customer Service by emailing a notice which states that you, the buyer, are canceling this agreement, or words of similar effect to mailsupport@mail.2hearts4love.com with subject line “Refund Request”. Please also include the user name, email address, and telephone number associated with your account.

23. NO CRIMINAL BACKGROUND NOR IDENTITY VERIFICATION CHECKS 2H4L DOES NOT CONDUCT CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS ON ITS USERS. 2H4L MAKES NO WARRANTIES AS TO THE CONDUCT, IDENTITY, INTENTIONS, LEGITIMACY, OR VERACITY OF USERS. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. ALWAYS USE YOUR BEST JUDGMENT AND TAKE APPROPRIATE SAFETY PRECAUTIONS WHEN COMMUNICATING WITH OR MEETING NEW PEOPLE. COMMUNICATIONS RECEIVED MAY RESULT FROM USERS ENGAGING WITH THE SERVICE FOR IMPROPER PURPOSES, INCLUDING FRAUD, ABUSE, HARASSMENT, OR OTHER SUCH IMPROPER BEHAVIOR.

24. ACCESSIBILITY

We strive to make our Service user friendly and accessible to visitors with disabilities. We regularly evaluate the content of our Service in relation to WCAG’s recommendations. Not all WCAG principals are operational and the application of WCAG recommendations may vary based upon the content on our Service.

25. COMMUNICATIONS

By agreeing to the terms of this Agreement, you consent to receive communications sent from us regarding the Service, Content, or your rights and obligations under this Agreement.

26. DIGITAL MILLENNIUM COPYRIGHT ACT ("DMCA")

Infringement- If you believe that your Content has been copied and posted on our Service in a way that constitutes copyright infringement, please provide the following information:

your contact information;
a description of the copyrighted work;
a link to the location of the copyrighted work;
a statement by you that the disputed use is not authorized;
a signed statement by you, made under penalty of perjury, that the information contained in your report is accurate and that you are the copyright owner.

27. ADS AND THIRD-PARTY CONTENT

Our Services may contain advertisements and promotions offered by third parties and links to other websites or resources. 2H4L is not responsible for nor endorse any products or services that may be offered by third-party websites or resources. If you choose to interact with the third parties made available through our Services, such party's terms will govern their relationship with you.

28. DISPUTE RESOLUTION

If you are dissatisfied with our Services for any reason, please contact Customer Service so that we can try to resolve your concerns.

29. ARBITRATION, CLASS-ACTION WAIVER, AND JURY WAIVER

Does not include users residing within the EU or European Economic Area, or where prohibited by law:

1. The exclusive means of resolving any dispute or claim arising out of or relating to this Agreement or our Services shall be BINDING ARBITRATION administered by JAMS under the JAMS Streamlined Arbitration Rules & Procedures. If the responding party requests to proceed in small claims court before the appointment of the arbitrator, the arbitration shall be administratively closed, and if requested after the appointment of the arbitrator, the arbitrator shall determine if the dispute should be decided in arbitration or if the arbitration should be administratively closed and decided in small claims court. You may not under any circumstances commence or maintain against 2H4L any class action, class arbitration, or other representative action or proceeding.
2. By using our Services in any manner, YOU GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend any claims between you and the Company. YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER CLASS PROCEEDING. Your rights will be determined by a NEUTRAL ARBITRATOR and the arbitrator shall determine all issues of the dispute. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons.
3. Any proceeding to enforce this arbitration agreement may be commenced in any court of competent jurisdiction. In the event that this arbitration agreement is for any reason held to be unenforceable, any litigation against the Company may be commenced only in the federal or state courts located in Clark County, Las Vegas, Nevada. You hereby irrevocably consent to the jurisdiction of those courts for such purposes.
4. The dispute settlement platform of the European Commission is available under http://ec.europa.eu/odr.

30. GOVERNING LAW

Except for users residing in the EU or European Economic Area or elsewhere where our arbitration agreement is prohibited by law, the laws of Clark County, Nevada, U.S.A., will apply to any disputes arising out of or relating to this Agreement or our Services. You consent to the exercise of personal jurisdiction of courts in the State of Nevada and waive any claim that such courts constitute an inconvenience.

31. ENTIRE AGREEMENT

These Terms with the Privacy Policy https://2hearts4love.com/privacy-policy/, our Cookie Policy https://2hearts4love.com/cookie-policy/, and any additional terms upon becoming a Member, contain the entire agreement between you and 2H4L regarding the use of our Services. The Terms supersede all previous agreements between us, written or oral. If any provision of these Terms is held invalid, illegal, or otherwise unenforceable, the remainder of the Terms shall continue in full force and effect. You agree that your Membership account is non-transferable and all of your rights to your account and its content terminate upon your death, unless otherwise provided by law. The failure of 2H4L to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by us without restriction. No agency, partnership, joint venture, or other special relationship or employment is created as a result of these Terms, and you may not make any representations on behalf of or bind 2H4L in any manner.

Your Right to Cancel - You may cancel your Membership, without penalty or obligation, at any time.

33. CALIFORNIA PAYERS

You may cancel any payment, without penalty or obligation; at any time prior to midnight of the third business day following the date your payment. If you paid using an external source such as your Apple ID or Google Play, refunds are handled by Apple/Google, not 2Hearts4Love. If you wish to request a refund, please visit https://getsupport.apple.com or if you subscribed using your Google Play Store account or through 2Hearts4Love online, contact customer support or by mailing or delivering a signed and dated notice that states that you, the buyer, are canceling this agreement, or words of similar effect. Please also include your name and the email address, phone number, or other unique identifier you used to sign up for your account.
